1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your access to and use of the University of Embu Christian Union ("UoEm CU", "we", "us", "our") website, mobile applications, APIs and related services (the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy, incorporated by reference.
When you register, we record your acceptance together with a timestamp (terms_accepted_at) and the effective terms_version, to demonstrate consent for compliance purposes.
2. Definitions
- "Account" — a registered profile on the Service, created directly or via Google Sign-In.
- "Member" — any registered user, including Normal Members, Associate Members and External Users.
- "Content" — any information, text, images or material submitted to the Service.
3. Eligibility
You must be at least the minimum legal age in your jurisdiction required to form a binding contract in order to create an Account. By registering, you represent and warrant that you meet this requirement and that your information is accurate.
4. Membership Categories
| Category | Description |
| Normal Member | Current student, identified by academic registration number, programme and admission year; generally active immediately upon registration. |
| Associate Member | Non-current-student affiliate (e.g. alumni or staff); requires administrative review and approval before becoming fully active. |
| External User | Individual interacting with the Service without a formal academic or associate affiliation. |
We reserve the right to request supporting information to verify your category, and to decline or revoke a category assignment made in error.
5. Associate Member Approval
If you register as an Associate Member, your account is marked pending until reviewed by an authorised administrator. You'll be notified by email of the outcome, and we may decline an application at our discretion.
6. Account Registration & Responsibilities
- You're responsible for keeping your credentials confidential and for all activity under your Account.
- You must provide accurate information and keep your profile up to date, including academic details.
- Notify us immediately if you believe your Account has been compromised.
7. Registration via Google Sign-In
- Creating an account with Google: we receive the profile information you consent to share (email, name, photo) and may create a linked local Account.
- Token handling: we avoid storing long-lived access tokens; where refresh tokens must be stored, they're encrypted and used only for the stated purpose. You can revoke access in Account settings.
- Account linking & recovery: if you registered via Google, you can set a password later via Account settings or the reset flow. Unlinking without a password first may make a Google-only Account inaccessible.
8. Academic Data & Certificates
For Normal Members, we derive academic details — course type, programme level, expected graduation year, current year of study — from your registration number. Certificates are generated using your name in the order you set in your certificate name-order preference. You're responsible for the accuracy of information you supply.
9. Terms Acceptance & Versioning
We keep an audit trail of your acceptance: terms_accepted_at and terms_version against your Account. If we materially update these Terms, we may require you to re-consent to the new version on your next login.
10. User Content & Rights Granted to Us
You retain ownership of Content you submit. By submitting Content, you grant UoEm CU a non-exclusive, worldwide, royalty-free licence to host, use, reproduce, distribute and display it solely to operate the Service — for example, displaying your profile or generating certificates.
11. Ministries & Community Participation
The Service lets you indicate involvement in one or more ministries within UoEm CU. This is used to display your affiliation and for administrative coordination, consistent with our Privacy Policy.
12. Prohibited Conduct
You must not use the Service to:
- Violate applicable law or the rights of any third party.
- Harass, threaten, impersonate or defraud any person.
- Upload malicious code or attempt unauthorised access, including credential stuffing.
- Scrape or bulk-extract data without our explicit written permission.
- Submit false or fraudulent academic, identity or membership information.
Violations may result in Content removal, suspension, or permanent termination of your Account, proportionate to the conduct concerned.
13. Verification, Security & Account Recovery
- Email verification: a one-time 6-digit code, stored hashed, expires after 24 hours.
- Password reset: reset codes are generated, stored hashed, and expire after a short period.
- Login protections: we log login attempts and may throttle or block an IP or Account showing suspicious activity.
14. Payments, Fees & Subscriptions
Where a feature requires payment, prices and billing terms are displayed clearly before you're charged. Refund policies, where applicable, are stated per feature. Billing enquiries: billing@uoemcu.ac.ke.
15. Privacy
Our Privacy Policy explains how we collect, use and protect your personal data, including data from Google Sign-In and academic data derived from your registration number. Accepting these Terms means accepting the Privacy Policy too.
16. Intellectual Property
All content, trademarks, logos and software comprising the Service are owned by, or licensed to, UoEm CU. You may not reproduce, distribute or create derivative works without our prior written permission, except as expressly permitted under Section 10 or by law.
17. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available", without warranties of any kind except as required by law. To the fullest extent permitted, UoEm CU is not liable for indirect, incidental, special or consequential damages arising from your use of the Service.
18. Indemnification
You agree to indemnify and hold harmless UoEm CU, its officers, leadership, staff and volunteers from claims, liabilities and expenses arising from your breach of these Terms or misuse of the Service.
19. Termination & Account Deletion
We may suspend or terminate your Account for breach of these Terms or legitimate operational or security reasons. You may request deletion of your Account at any time, handled per our Privacy Policy.
20. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya [confirm jurisdiction with UoEm CU leadership]. Disputes will first be addressed through good-faith engagement, and failing resolution, are subject to the exclusive jurisdiction of the competent courts of Kenya, unless otherwise agreed in writing.
21. Changes to These Terms
We may amend these Terms from time to time. Material changes will be highlighted and you may be required to re-accept before continuing to use the Service. The effective date above will be updated accordingly.
